Contempt plea disposed of in Aafia case
Justice Ijaz Ahmad Chaudhry of Lahore High Court on Monday disposed of a contempt petition against the Ministry of Interior for not giving documentary evidence proving Dr Aafia Siddiqui’s innocence to the Foreign Ministry for further transmission to the US District Court.
Disposing of the petition, the judge observed that there was no need of the court’s directions as the departments concerned had not any tangible evidence in order to prove the innocence of Dr Aafia before US court.
The judge, however, observed that the petitioner, Barrister Javed Iqbal Jaffrey could write a letter and provide evidences, if he had any, to the US District Court in his personal capacity. Earlier, Interior Secretary Qamaruz Zaman told the Lahore High Court that the government had no documentary evidence of Dr Aafia Siddiqui and her children’s kidnapping from Karachi.
Appearing in connection with a contempt petition against the Interior Ministry, he said police had also failed to collect any evidence in this regard during the course of investigation. He further said that Aafia’s son was also unable to substantiate presumption about their kidnapping from Pakistan.
The secretary further said that an official letter along with the press clippings regarding facts about the case had been sent to Hussain Haqqani, the Pakistani ambassador to America. He said the ambassador would deliver the same to the US State Department and the court which was going to announce its verdict in Aafia’s trial on August 16.
On the previous hearing, the court had sought explanation from the Interior secretary, asking as to why the ministry did not provide documentary evidences of the innocence of Dr Aafia to the Ministry of Foreign Affairs for their final delivery to the US District Court.
Barrister Jaffree pleaded that last month the court had ordered the Ministry of Foreign Affairs to immediately write an official letter to the trial judge in the United States district court of New York, stating that Dr Aafia Siddiqui was illegally kidnapped from Karachi in 2003 along with her three innocent children.
